These are the Booking Terms of Low Briery Holidays. Please read them carefully before making a booking. If you have any questions, contact us.

Terms & Conditions

1. Basis of Contract

The submission of the booking form constitutes an offer by you to let the Property from Low Briery Holiday Park in accordance with these Terms and Conditions. Your booking shall only be deemed accepted upon receipt of the deposit and written acceptance of the booking by us and on which date a contract shall come into existence (the “Contract”). The Contract and any documents referred to in it will constitute the entire agreement between us. This Contract shall be governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English Courts.

This Contract is made for the purpose of a holiday and is not intended to create the relationship of landlord and tenant between us.

2. Payment

A booking deposit as set out in the booking form is payable if the booking is made more than 30 days before the date the Holiday Period commences (“Commencement Date”). The balance of the Booking Price is payable 30 days before Commencement Date. Non-payment of the balance of the Booking Price on or before the due date shall be construed as a cancellation of the Contract by you. For bookings made less than 30 days before the Commencement Date, the Booking Price is payable on submission of the booking form.

3. Damage Deposit

A damage deposit of £200 is required upon arrival when checking-in. This is an initial authorisation hold, not a charge, which means that you wont be able to access these funds in your bank account until the hold is released. You are required to comply with the obligations detailed in paragraphs 8, 11, 12, 13 & 14 below, during your stay at Low Briery. We will deduct from the damage deposit the cost of remedying any breach of these obligations together with the cost of any service or goods provided. The balance of the damage deposit will be released within 7 days of your departure. Your bank may take an additional 21 days to process the release of these funds, however this can vary depending on the card you use. Please allow up to 4 weeks for the funds to appear back in your account.

4. Cancellation

Any cancellation made by you for whatever reason shall be in writing and addressed to Low Briery Holiday Park, Keswick, Cumbria, CA12 4RN or email stay@lowbriery.co.uk.

Should you cancel more than 30 days before the Commencement Date, you will receive a full refund minus a £25.00 cancellation fee.

Should you cancel less than 30 days before the Commencement Date, you are liable for the full amount payable and no refund can be given.

Any deposit paid for bookings over the Christmas or New Year period is non-refundable.

We strongly recommend that you take out Cancellation Insurance.

5. Changes of Date

We may at our discretion agree to change the dates of the Holiday Period upon request from you. If the dates of the Holiday Period are not changed the booking will remain in place and all monies will remain due.

6. Change of Accommodation

We may at our discretion agree to change the accommodation reserved upon request by you. If the accommodation is not changed the booking will remain in place and all monies will remain due. We reserve the right to change the accommodation booked at any time, if the need for repairs and/or maintenance arises. We will endeavour to provide similar accommodation or an alternative accommodation that suits your needs.

7. Period of Hire

Check-in time on the Commencement Date is no earlier than 4pm and check-out time on your day of departure is no later than 10am.

8. Noise Policy

Any loud noises that may disturb other guests such has the holding of parties, singing, shouting, banging of car doors, dogs barking etc. especially after 22:00 must be avoided. We reserve the right to eject disturbers without refund and with no guarantee of alternative accommodation.

9. Use of Property

The number of persons occupying the Property must not exceed the maximum number stipulated in the property description. Low Briery Holiday Park does not accept Stag or Hen parties, single sex groups of more than 4 people unless permission has been granted by Low Briery Holiday Park and work groups. The Property will be used for personal and domestic purposes only. The property shall not be used for any commercial purposes without our written consent. We reserve the right to refuse entry to the entire party if these conditions are not observed.

10. Complaints

Should there be any cause for complaint during the occupation of the Property it must be notified promptly to us and in case of serious problems confirmed in writing. Action cannot be taken over complaints made after you have departed.

11. Breakages or Damage

In the event of breakages, damage or the need for additional cleaning you shall reimburse us for replacement, repair or extra cleaning costs incurred. You will be invoiced for any costs not paid upon your departure.

12. Care of the Property

You shall not cause any damage to the Property including the grounds. You shall keep the Property and its furnishings, pictures, kitchen equipment and all other fittings and effects in good and clean condition. You shall be responsible for repairing any damage.

12A. Electric Car Charging

It is prohibited to use electrical plug sockets to charge your electric vehicles (cars or otherwise) on the park. A fine of £250 will be charged if any unauthorised use of our electrical charging points is found. We will be monitoring use continuously. There is an electric vehicle charging point located in our main carpark, this is available for all guests to use. Please note that this is not a fast charger and so could take several hours for a full charge. There are also electric car charging points at Booths supermarket and the central carpark in Keswick.

13. Pets

Guests must adhere to the pet policy set out in the description of each property. Only fully house trained adult dogs are accepted within properties. We reserve the right to refuse access to the property or to eject without refund or guarantee of alternative accommodation anybody not adhering to this policy. Pets should never be allowed onto furniture within the property or be left on their own within the accommodation. Any damages caused by pets (including the soiling of carpets and upholstery) which require additional cleaning, replacement or repair must be paid for by you. Dogs MUST be kept on a lead at all times when walking around Low Briery Holiday Park.

14. No Smoking Policy

In line with English law, all of our properties are entirely non-smoking. Any failure to adhere to this policy will result in a fine of up to £300.00 payable by you.

15. Liability

We (for ourselves, employees and agents) shall not be liable to the Client or third parties for any accident, damage, loss, injury, expense or inconvenience, which may be suffered, incurred, arise out of or in any way connected with the letting. No term of the Contract is enforceable under the Contracts (Rights of The Third Parties) Act 1999 by a person who is not a party to the Contract. If the Property becomes unavailable or unusable for some reason prior to the date of a booking, then our obligation will be to (1) use our best endeavour to find a suitable alternative property, or failing which (2) to reimburse you for any monies paid.

16. Warranties

We do not warrant and are not responsible for the accuracy of any verbal information given or statements made by its staff.

17. Website and Advertisements

We aim to ensure that the information and descriptions provided are accurately conveyed on the official website and any authorised third-party websites or advertisements. There may be small differences between the actual accommodation and its description as we are always seeking to improve services and facilities. Occasionally, problems mean that some facilities or services become unavailable, and if this is the case we will tell you as soon as reasonably practical after we have been made aware of the situation. Similarly we cannot accept responsibility for any changes or closures to local area amenities or attractions mentioned on the website or advertised elsewhere.

18. Right of Entry

We shall be allowed the right of entry to the Property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

19. Children

You must accept responsibility for the behaviour and safety of any children accompanying your party.

20. Cancellation Insurance

Cancellation Insurance is strongly recommended.

21. Pricing

We reserve the right to change the advertised prices of our properties at any time without prior notification. We will confirm the price of your holiday at the point of booking and the price agreed for the Property (excluding any extras), as specified on the booking form will remain firm and will not be changed under any circumstances. Prices are inclusive of VAT (20%) where applicable.

22. Wi-Fi

Site wide WiFi is provided free of charge. This service is provided on a fair use basis and must not be used for any illegal purposes. We reserve the right to permanently block devices from using the service without prior notice if these conditions are not met. Due to the structural nature of some of our accommodation, we cannot guarantee that every property will have signal. The Wi-Fi signal can be poor/intermittent when the park is full with guests, we are currently working to increase our bandwidth to keep up with customer demand. Please be patient whilst works are carried out, we apologise for the weak signal and any inconvenience this may cause.
